Terms of use

These terms apply to VideoCaption at videocaption.io (the "service"), run by Yann Kost, Switzerland ("we"). By requesting an access code you accept them. If you use the service for a company, you confirm you may accept them for it.

1. What the service does

You upload video clips. The service transcribes the speech in each clip, draws captions on it in a look you choose, and gives you the captioned video to download. It works by the batch: one look for all clips in your queue, one price per clip.

The transcription and the caption timing are produced automatically by a speech-recognition model. They are as good as the model hears. You can correct the text before rendering, and the still previews and the free twenty-second sample exist so you can check the result before you pay for it.

2. Access

There is no password. You give an e-mail address and we send a six-character code to it; the code opens the service for one hour and can be used once. A signed-in browser stays signed in for thirty days. Anyone who can read mail at your address can use your credits, so keep that mailbox yours.

You must be at least 18, or use the service with the consent of a parent or guardian.

3. Credits and payment

  • The service is paid with credits, bought in packs. Prices are shown before you buy and include VAT where it applies. Payment is handled by Stripe; we never see your card details.
  • A captioned clip costs 5 credits for up to 2 minutes of its trimmed length, and 5 more for each further 2 minutes started; the queue shows the number next to each clip before you render. Rendering the same clip again with a different look costs the same again. Still previews and the ten-second sample are free.
  • Credits are taken when a render starts. If the render fails on our side, the credits come back. A clip with no detectable speech is not charged.
  • The subtitle files of a clip (SRT and VTT) come with its captioned video. On their own they cost 5 credits per clip, whatever its length, taken when you ask for them.
  • Credits do not expire. They are tied to the e-mail address they were bought under and cannot be transferred or paid out.
  • Credits are not refundable, with three exceptions: unused credits within fourteen days of the purchase, refunded to the payment method used on request; the cases in sections 7 and 10, where we stop the service or change these terms; and special cases we may recognise at our discretion, such as a prolonged outage that kept you from using what you paid for. Spent credits are never refunded. A refund you ask for must come to at least €15; smaller amounts are not processed, which means the Small pack is not refundable. Write to contact@videocaption.io from the address of the account.

4. Your content

You keep every right to the clips you upload and to the captioned videos you download. You give us only what is needed to do the work: to store the clip, send it to our transcription and rendering providers, draw the captions and hand the result back to you.

You confirm that you hold the rights to upload each clip and to have it processed this way, including any rights of the people in it. You must not upload content that is illegal, that infringes someone else's rights, or that shows sexual abuse or violence against real people. We may remove such content and close the account.

5. Files and how long they stay

A captioned video stays downloadable for 48 hours after it is rendered; the screen shows the exact time. After that the file is gone and cannot be recovered, so download what you need. Uploads you never render, and the queue rows themselves, are removed 7 days after the upload. The privacy policy describes this in full.

6. Limits

Clips may be up to 20 minutes long each. We may set limits on file sizes, on the number of clips in a queue and on how often the service can be called, to keep it working for everyone. Automated use through scripts is allowed as long as it stays within those limits.

7. Availability and changes

We run the service with care but do not promise it is available at all times or free of errors. We may change the looks, the prices and the features. A change of price applies to purchases after it; credits already bought keep their value in clips.

We may stop the service altogether. If we do, we give at least thirty days' notice by e-mail to the addresses with unused credits and refund those credits.

8. Liability

We are liable for damage we cause by intent or gross negligence. For anything else our liability is limited to the amount you paid us in the twelve months before the event, and we are not liable for indirect damage such as lost profit or lost data, to the extent the law allows such a limitation. Nothing here limits liability where Swiss law does not allow it to be limited.

The service is not made for content where an error in a caption could cause harm, such as medical, legal or safety instructions. Check such captions yourself before publishing them.

9. Closing an account

You can stop using the service at any time. To have your address and data deleted, write to contact@videocaption.io. Remaining credits are lost with the account unless one of the exceptions in section 3 applies, so spend them first. We may close an account that breaks these terms; remaining credits are then lost.

10. Changes to these terms

We may change these terms. The date at the top says when they last changed. For a change that matters to you, we tell the addresses with unused credits by e-mail at least fourteen days before it takes effect. If you do not agree, you can ask for your unused credits back within that time.

11. Law and courts

Swiss law applies, without its conflict-of-law rules and without the United Nations Convention on Contracts for the International Sale of Goods. The courts at our seat, Basel, Switzerland, have jurisdiction. If you are a consumer, the courts that mandatory law gives you remain open to you.

These terms are written in English; the English text is the one that counts.
